Waiver and Release of Liability for Relocation of Play Equipment
This Agreement is made between:
Rainbow of Northeast WI
(Hereinafter referred to as "Rainbow")
AND
Customer Requesting Move
1. Acknowledgment of Risk and Limitations
The Customer hereby requests that Rainbow relocate play equipment originally installed at the Customer's property ("Play Equipment") from its current location to a new location, as specified by the Customer. The Customer understands and acknowledges that the Play Equipment is specifically designed and built for its original installation site, which has been leveled and prepared in a way that ensures safe and optimal performance. Moving the Play Equipment to a new location may result in:
Unleveling: The new site may not be as stable or level as the original site, which may impact the overall performance and safety of the Play Equipment.
Potential Damage: Due to the nature of the move, there is a risk of damage to the Play Equipment, including but not limited to scratches, dents, cracks, or other forms of wear.
Alteration in Setup: The Play Equipment may not be set up or anchored as perfectly as when originally installed, potentially affecting its stability and functionality.
2. Waiver of Liability
By signing this waiver, the Customer agrees to hold harmless and indemnify Rainbow, its employees, contractors, agents, and affiliates, from any liability or claims for damages, injuries, or losses that may arise during or after the relocation of the Play Equipment. This includes, but is not limited to:
Damage to Play Equipment during the moving process.
Damage to Property as a result of the relocation process.
Injury or harm to individuals who may use the Play Equipment post-relocation.
The Customer further acknowledges that the relocation process is at their own risk, and Rainbow will not be responsible for any of the aforementioned issues that may arise after the move.
3. Customer's Responsibility
The Customer is responsible for ensuring that the new location for the Play Equipment is safe, level, and clear of any obstacles that could affect the integrity of the installation. It is also the Customer's responsibility to inspect the Play Equipment after relocation to ensure it is functioning to their satisfaction. Rainbow will make best efforts to ensure that the Play Equipment is relocated safely, but no guarantees are made regarding the final setup or condition of the equipment post-relocation.
4. Agreement to Terms
By signing below, the Customer acknowledges that they have read and understood this Waiver and Release of Liability. The Customer agrees to release Rainbow from any and all liability and claims arising from the relocation of the Play Equipment.
