ASSUMPTION OF RISK AND RELEASE OF LIABILITY

IMPORTANT LEGAL NOTICE

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

BY SIGNING THIS AGREEMENT, YOU ACKNOWLEDGE CERTAIN RISKS ASSOCIATED WITH PLAYGROUND ACTIVITIES AND AGREE TO RELEASE CERTAIN CLAIMS AGAINST PLAYGROUND KING OF WISCONSIN.

PLEASE READ CAREFULLY BEFORE SIGNING.

If you do not wish to sign this Agreement, you may choose not to participate in the showroom play area.

1. PARTICIPATION IN RECREATIONAL PLAY

The Playground King of Wisconsin showroom contains playground equipment and play structures intended for demonstration and recreational play by customers and their children.

Activities may include:

  • climbing
  • sliding
  • swinging
  • jumping
  • running
  • interacting with playground equipment

Participation in these activities is voluntary recreational use of playground equipment.

2. ACKNOWLEDGEMENT OF RISKS

I understand that playground activities involve inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

  • falling from equipment
  • slipping or tripping
  • collisions with other participants or equipment
  • misuse of playground structures
  • equipment wear or unexpected movement
  • physical exertion

These risks may result in injury, illness, property damage, paralysis, or death.

I acknowledge that the presence of other participants may increase these risks.

I voluntarily choose to participate in these activities with full knowledge of these risks.

3. ASSUMPTION OF RISK

I voluntarily assume all risks associated with participation in playground activities at Rainbow of Northeast Wisconsin, whether known or unknown.

I accept responsibility for my own safety and the safety of any minor child under my supervision.

4. RELEASE OF LIABILITY FOR ORDINARY NEGLIGENCE

To the fullest extent permitted under the laws of the State of Wisconsin, I agree to release and hold harmless:

Jollie New Enterprises DBA Playground King of WI, and their:

  • owners
  • officers
  • managers
  • employees
  • contractors
  • agents
  • representatives
  • affiliates

from any claims, demands, or causes of action arising out of participation in showroom play activities resulting from ordinary negligence.

This release does not apply to intentional misconduct, reckless conduct, or any liability that cannot legally be waived under Wisconsin law.

5. SUPERVISION AND SAFETY RULES

Participants agree to follow all posted safety rules and staff instructions.

Parents or guardians must actively supervise their children at all times.

Participants agree:

  • to use equipment only as intended
  • to behave safely and respectfully
  • to stop activity if instructed by staff

Rainbow of Northeast Wisconsin reserves the right to deny or revoke access to the play area for unsafe behavior.

6. HEALTH AND FITNESS

I certify that I and/or my child are physically able to participate in recreational play activities.

I understand that if I have concerns regarding medical conditions or physical limitations, I should consult a medical professional before participating.

7. MINOR PARTICIPANT AGREEMENT

If signing on behalf of a minor child, I represent that I am the parent or legal guardian of the minor participant.

I agree to the terms of this Agreement both individually and on behalf of the minor child.

I accept responsibility for supervising the minor participant and ensuring compliance with all safety rules.

8. WISCONSIN SAFE PLACE NOTICE

I understand that Wisconsin law requires property owners to maintain reasonably safe premises.

This Agreement does not waive any rights that cannot legally be waived under Wisconsin law but applies specifically to risks associated with voluntary recreational use of playground equipment.

9. PHOTO AND MEDIA DISCLOSURE

Rainbow of Northeast Wisconsin may occasionally capture photographs or video within the showroom for purposes including:

  • marketing
  • social media
  • advertising
  • website content

These images may include general scenes of the showroom or play equipment.

Playground King of Wisconsin will not use identifiable facial images of children or participants for marketing purposes without direct written permission from a parent or guardian.

If identifiable photos are desired for promotional use, a separate written consent form will be provided.

10. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Wisconsin.

11. SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

12. Annual Validity Clause

This Agreement remains valid for 12 months from the date signed for future visits.

13. Emergency Medical Consent

Parent authorizes staff to contact emergency services if needed.

 

ACKNOWLEDGEMENT OF UNDERSTANDING

BY SIGNING BELOW, I CONFIRM THAT:
